Effective 19May2008, anyone who desires to become or remain a member of TesasTeaMails please read and abide by the following Terms of Service (Site Policy):
Please bear in mind that the following Site Policy are guidelines for membership rather than ironclad, written in stone laws. They are rules and just as every rule has an exception, everything can be changed. Anything unacceptable should be discussed with us so that we may ammend this page as necessary.
As a result of recent cheating, we have had to change some of the terms and conditions of membership. We make no apologies to honest members who are having to adhere to these policies because we need to protect our programs so that we can continue to pay all of our honest members. Therefore, this is for your benefit.
TesasTeaMails Terms Of Service
By signing up and actively using the TesasTeaMails program you agree to all terms and conditions set forth in this agreement. TesasTeaMails may, at any time, may choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members. Members will be informed of any and all changes to this policy via an email to them using the same method by which all emails are delivered to the member. If any modification is unacceptable to you, please contact TesasTeaMails admin before you terminate this agreement. Your continued participation in the TesasTeaMails program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change.
Responsibility of Members:
You must be of legal age to enter into contracts in your country of residence or older to participate in this program. Our program is open to all English speaking and understanding members and is void where prohibited by local governing laws. Inasmuch as you are required to be an adult to be a member here, we will not dictate to you what programs you may not join or advertise here and it is the responsibility of the Ad Reader to decide for him/her self if the program is worth your participation in. We will include a revisit link in every new ad sent out from this point forward so you will know what site and what page is being advertised. It is your responsibility to decide whether or not you will visit the site being advertised.
Your current physical location must be specified in your Profile before you click any links. If you are going on vacation outside your country of residence, you must change your userinfo to reflect what country you are going to if and only if you plan on clicking any links while in that country. It is your responsibility to change the country back to the country you return to prior to clicking any links in that country. Exception to this rule is if you are traveling within Europe to any restricted search friendly country.
You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. You may not sign-up multiple times with different email addresses. Your computer must not be shared with another individual who has an existing TesasTeaMails account unless prior approval has been secured from TesasTeaMails admin.
You will use your User ID (or email address) and password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your account and following the "User Account Info." link.
You are solely responsible for any and all use of your TesasTeaMails account including authorization by you to any third party individual who may use your account.
Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by TesasTeaMails be detected it will result in member suspension or termination and possible legal action. (This includes, but is not limited to: use of autoclick/clickbot software, selecting "cheater", "delete me", or any of the other obviously cheat related interests in your categories of interest, signing up for multiple accounts, quitting and rejoining before thirty (30) days have passed, using any anonymous or elite proxy while logged into TesasTeaMails, and/or clicking more than 3 cheat links).. You are not allowed to sell, transfer or give away your ads redemptions to anyone without a prior reseller's authorization in effect with TesasTeaMails or the ads redemptions will not be honored and your account may be terminated.
Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account may be grounds for immediate termination.
Before you join any site, be sure that you check it out thoroughly to ensure that your time will be well spent. If you do not receive favorable results from any participation in any advertisers' ads, please do NOT contact the advertiser or TesasTeaMails Admin to complain. Instead, please contact the entity being advertised to resolve any issues that may arise.
You must maintain an email account that will be used by TesasTeaMails for the purpose of sending you email regardless of where your paid emails are sent. Should you be in violation of this, your account will be suspended until such time as we have a usable email address on file for you. TesasTeaMails cannot send you notice of this if TesasTeaMails has no way of contacting you. You agree to receive e-mail advertising from TesasTeaMails either to your email address, the Site Inbox or both, whichever is more convenient for you.
If your email bounces repeatedly, your account may be suspended until such time as you get another email address with a different email domain server.
All accounts are suspended following 60 days of inactivity and can be reinstated for up to 365 days after their most recent click.
Suspended accounts are deleted following 365 days of inactivity.
Canceled accounts are deleted following 30 days of inactivity.
Members who cancel their own accounts are deleted 30 days after their most recent click.
Members caught cheating will have their account canceled and deleted 30 days after their most recent click.
Members with questionable activities will get their account suspended until they contact admin and we work it out.
For purposes of member deletion, inactivity is defined as failure to click links. Simply logging in without clicking any links will not keep you from getting your account suspended.
In the event your e-mail account on file becomes closed, bounces email from TesasTeaMails or blocked to messages from TesasTeaMails once, your account with TesasTeaMails will be set to inbox only without further warning and will stay this way until you get another email address. This especially applies to e-mail accounts returned for being full. Any member sending us gibberish demonstrates their inability to comprehend the English language and will result in automatic termination of account, forfeiture of downline and all earnings to date of termination.
Relationship of the Parties:
You and TesasTeaMails are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and TesasTeaMails. You understand that you do not have authority to make or accept any offers or make any representations on behalf of TesasTeaMails. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. You are solely responsible for the reporting and payment of any taxes for money earned while using the program.
Prohibited Actions:
You may not retain emails for later clicking unless the email specifically states otherwise.
You may not harvest paid links for later clicking.
You may not post anywhere how to get past our security.
Redemptions:
Redemptions are for the member only and if they try to redeem for an ad for someone other than themselves, the redemption will be forfeit. Exceptions to this are on a case by case basis. Search ads are acceptable for redemptions.
Negative Value Links:
Negative value links are included in emails and on the site every day which remove points or cash from the account. If you do as you are paid to do, which is read before you click, these negative value links will be obvious. Therefore, they will not be marked as cheat links. They are not to be clicked at any time or the member will have cash or points deducted each time. Should the member click these to the point of getting three (3) or more clicked, we will presume you either don't read or you are not here to make money and your account will be canceled. Should you click sufficient negative value links to obtain a negative balance, it will be your responsibility to contact TesasTeaMails to arrange for your account to be brought to a non-negative balance or your account is subject to termination. Using software to do your clicking is not acceptable at TesasTeaMails under any circumstances.
Click 3 cheat links in any calendar month and your membership here will cease.
Falsifying Information:
We check ALL accounts at one point or another several times during the course of your membership. If you claim to live somewhere other than your actual country of residence, your account WILL be immediately canceled, forfeiting all pay, upgrades, referrals and running ads.
English Tests:
TesasTeaMails is only for those who read and understand conversational US English. Periodic English tests are given randomly and to the membership at large.
These will not be marked because you are supposed to be able to read and understand English. Same rules apply to English Tests as do apply to Cheat Links in that they will not be marked as English Test but they will be obvious to anyone who reads before they click.
Vacations:
TesasTeaMails will not tell you how long you may be on vacation, but if you will be gone for more than sixty (60) days and you do not notify TesasTeaMails at some point prior to or during your absence, your account will be suspended according to Site Policy.
Advertising:
TesasTeaMails is for English speaking members. Therefore, all advertisements must be entirely in English. No ads in any language other than English will be accepted or published. There are no exceptions to this and include all ads both in the emails and within the site. Should any ads be found to have been changed once they have been approved and published, the ads will be pulled and there will be no refunds for any unused hits. Members who submit ads more than once that are not entirely in English will forfeit any payments made. Members who submit links to pages containing malware will get the ad rejected without refund.
Limitation of Liability:
TesasTeaMails will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or TesasTeaMails program, even if TesasTeaMails has been advised of the possibility of such damages. Furthermore, TesasTeaMails aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement.
Payments:
Members may earn by receiving paid-emails and visiting the advertiser websites after they have entered their member ID in the area on the website provided by TesasTeaMails. Members may earn by referring new members to the TesasTeaMails program. Members will
earn a percentage of advertising revenues collected by TesasTeaMails. Members will be paid via AlertPay/GPT-Pal/Check to US ($0.50 fee)/Check to Canada ($0.75 fee)/Check outside North America ($2.00 fee)/e-gold/Paypal.
TesasTeaMails will pay members when their balance reaches the minimum payout rate set by TesasTeaMails. The exceptions to this rule are:
If you have elected to receive payout before you reach the minimum cashout as set for your membership level.
After you have been a member for more than 1 year, you are entitled, upon request, to receive your earnings monthly. Each month you want paid, you need to submit another request.
Once the member has reached payout, they may request payment. Payments will be made as soon as funds allow (egold sometimes takes a few days), barring any unforseen circumstances. TesasTeaMails admin is located in central Florida USA. Should there be a hurricane which knocks our power out, no member payments will be made until power is restored.
In order to be fair, payout requests are made in the order they are received with no preferential treatment given based on membership level.
Payouts:
This applies to any and all payout requests from now on and applies to all members. Members must have Personal + Downline Earnings of at least the portion stated below of the amount of the cashout request not including selling points for cash or other credits given by TesasTeaMails.
Minimum Payout for free members is $ 2.00
Minimum Payout for Teacup members is $2.00
Minimum Payout for Baby Tesas members is $1.50
Minimum Payout for DemiTasse members is $1.00
Minimum Payout for Tesas members is $0.50
No Minimum Payout for Mama/Papa members - need to be an active member (read and click ads)
An active member is one who clicks at least one click every thirty (30) days
PAypal accounts are paid via masspay on the 13th of the month with a $0.50 USD minimum to be paid.
Members whose membership is terminated by you or TesasTeaMails are not allowed to rejoin for a period of not less than thirty (30) days.
There is a $2 maximum fee for the member to be paid by check regardless of what amount the member requests. Exceptions to this rule are Canada pays $0.75 and US pays $0.50. The reason for the lower fee is that all the fee is for is to cover postage and an envelope.
Spam:
You may not promote your referral links through unsolicited emailing (i.e. SPAMMING), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with TesasTeaMails and may result in legal prosecution. TesasTeaMails strictly enforces anti-Spamming laws. Spamming is a federal crime. Any member caught Spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. TesasTeaMails may charge up to $5 per spam email sent. Multiple sign-ups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. TesasTeaMails will file charges for recovery of any earnings received from multiple sign-ups.
Conflicts of Site Policy:
From time to time, TesasTeaMails edits the Terms and Site Policy and if there ever exists any conflicts of TOS or Site Policy, please contact TesasTeaMails admin for clarification. Any time Site Policy is amended in the paid emails, it is binding upon TesasTeaMails and its members. Site Policy is changed from time to time to keep us with the times. TesasTeaMails is not autonomous, respects the wishes of the honest members and welcomes all ideas whether they from within or without.
